General Terms and Conditions.
For the website subscription «Pixify-AI» of BE United Group. Status: 24 September 2026.
1. Provider & Scope
The provider of services under pixify-ai.ch is BE United Group, Bosnjak (owner Gabriel Bosnjak), Alte Aach 1, 8599 Salmsach, Switzerland («Pixify»). These terms and conditions apply to all website subscriptions concluded via pixify-ai.ch between Pixify and the ordering person or company («Customer»). Deviating conditions of the Customer do not apply.
2. Services
Pixify offers the following products:
a) Website Subscription: the automated creation of a website based on the Customer's information (including texts and design according to the chosen template), the registration of one .ch domain of choice, hosting with SSL certificate, and access to the Customer Panel for independent customisations.
b) Online Shop Subscription: all services of the Website Subscription, plus an online shop under the Customer's own domain (product catalogue, shopping cart, checkout) as well as the Shop Panel for managing products, orders, shipping costs, and payments.
c) Google Business Profile Service (one-time service): the setup and optimisation of the Customer's Google Business Profile including Bing Places, support through the Google verification process, and the handover of a review link. The price is a one-time fee of CHF 49.–, payable in advance; clause 8b governs the details.
The subscription products (a) and (b) include four language versions (German, French, Italian, English) with a language switcher; language versions not written by the Customer are machine-translated. Provision is generally made within 24 hours of receipt of payment and complete information; this is a guideline value, not a guaranteed deadline.
Add-on extensions (e.g. appointment booking, blog, Google Profile Service, signature designs, additional pages) are optional supplementary services at the prices shown on the website or in the Customer Panel (one-time or recurring). Access to the Customer Panel is granted with the release notification upon completion of the website. The Customer may export their content at any time (for the online shop, in particular product and order data as CSV).
3. Price & Payment
The subscription price is CHF 99.– per year for the Website subscription and Shop S CHF 249.– or Shop M CHF 399.– per year for the Online Shop subscription, depending on the plan. In the first contract year, the price covers creation and domain; hosting valued at CHF 99.– is complimentary. From the second year onwards, the same amount covers hosting, domain renewal and support. For domain extensions whose registration costs more than a .ch domain, an annual surcharge applies, which is shown in the ordering process and on each invoice (currently .com, .net, .org, .it +CHF 10.–/year; .info, .co +CHF 25.–/year). Payment is made annually in advance via the payment service provider Stripe (credit card/TWINT). If renewal payment fails, Pixify may suspend services after notice. Otherwise, statutory consequences apply in case of payment default (Art. 102 et seq. CO, default interest 5%).
4. Term, Renewal & Cancellation
The contract term is one year and renews automatically by one additional year at a time. The Customer may cancel no later than three months before the end of the current contract year with effect at the end of the current, already paid subscription year – online at pixify-ai.ch/kuendigen. The decisive factor is receipt of the cancellation before the renewal date. After the expiry of the paid year, hosting and support cease; clause 6 governs the domain. The Customer may back up their content until the end of the contract via the Customer Panel; 30 days after the end of the contract, the website data will be deleted.
5. Commencement of Services
The Customer agrees that Pixify will begin creating the website and registering the domain immediately upon receipt of payment. Since the domain registration is carried out in the Customer's name without delay and the digital service thereby begins running in full, there is – to the extent permitted by law – no right of withdrawal in respect of services already rendered.
5a. Non-binding Test Demos («Sandbox»)
Demo environments offered on the website are solely for non-binding exploration. They do not establish a contractual relationship, may be modified or discontinued at any time, and are automatically and irreversibly deleted – along with all input entered therein – after a short period (generally 60 minutes). In demos, purchases, enquiries, and AI functions are deactivated; there is no entitlement to availability or retention of demo content. Please do not enter real personal data in demos.
6. Domain Ownership
The domain is registered in the name of the person or company specified in the ordering process as the legal holder – the domain belongs to the customer. After contract termination, Pixify ceases automatic renewal of the domain and informs the customer in good time so that he can transfer the domain to a provider of his choice if needed. If the customer uses an existing domain, it is moved to the operator's registrar using the transfer code (AuthCode) provided by the customer; ownership remains entirely with the customer. The customer must obtain the transfer code in good time from their previous provider; delays due to missing or invalid codes are not Pixify's responsibility. Publicly visible, email-relevant DNS entries are backed up before the migration and reinstated afterwards. Existing email accounts and services remain with the previous provider and are not part of the service.
7. Customer Obligations
The customer warrants that their details are accurate and that the content they provide or approve (texts, images, logos, links) does not infringe any third-party rights or applicable law. The customer is responsible for the content of their website. They indemnify Pixify against any third-party claims arising from a breach of these obligations. Pixify may remove obviously unlawful content after informing the customer. Pixify may display the completed website with domain and company name as a reference on pixify-ai.ch; the customer may object to this at any time informally (an email is sufficient), whereupon the entry will be removed.
7a. Usage Rights, Copyright & Transfer
Your content belongs to you. Texts, images, your logo, company data, reviews and everything you contribute in the customer portal or that is created on your behalf remains your property. You can download this content at any time and use it elsewhere – including after the contract ends.
The system belongs to us. The templates, the underlying design, the program code, the modules (gallery, appointment booking, online shop, blog, customer portal) as well as the platform pixify-ai.ch are protected by copyright and remain the property of BE United Group. This also applies to the completed website insofar as it goes beyond your own content.
What your contract includes: You receive the non-transferable, non-exclusive right to use the website created for you for your own business for the duration of the contract. You may manage content, change texts and images, and use all activated features.
What is not permitted – without our prior written consent:
- Passing on, renting, sublicensing or selling the website or parts thereof to third parties.
- Using, copying or transferring templates, design, program code or individual modules outside of your own website into another system.
- Using one account to create or offer websites for third parties – for example as a freelancer, agency or reseller.
- Rebuilding or imitating the system or substantial parts thereof, including reverse engineering of the platform.
- Passing on login credentials for the customer portal to third parties who are not working for your own business.
One account, one business. Each contract applies to one company and one website. Those with multiple businesses require multiple contracts.
Would you like to offer websites to your own clients? That is possible – but not through a standard account. Get in touch with us: for agencies, freelancers and resellers, there are dedicated partner terms. This gives both parties a clear foundation.
In the event of a breach, we may suspend access and terminate the contract without notice. Amounts already paid will not be refunded. Claims for damages and injunctive relief remain reserved. Your own content will still be made available to you for export – it belongs to you.
After the contract ends, your right to use the templates, design and modules ceases. Your domain and your content remain yours (see clause 6); we are happy to export your texts and images in a common format.
7b. Content Published by the Customer & Custom Code
The customer is solely responsible for all content they publish or modify via the customer panel (texts, images, links and – where available – custom HTML sections). They warrant that they hold the necessary rights and will not publish any unlawful, deceptive or third-party rights-infringing content. Technical filters (e.g. the automatic removal of scripts from custom HTML sections) serve security purposes but do not replace a legal review and do not establish any duty of review on the part of the provider. The customer indemnifies the provider against any third-party claims arising from content published by them. The provider may remove obviously unlawful content with prior notice, or immediately in urgent cases.
8. Automatically Generated Content
Text and design suggestions are partly generated in an automated (AI-assisted) manner. The customer reviews the content and may adjust it during the ordering process and at any time in the customer panel. The version approved or retained by the customer is authoritative.
8a. Special Provisions for the Online Shop
Own payment account: Payments from the shop's end customers flow directly into the client's own Stripe account. Pixify is neither the payment recipient nor a contracting party to the purchase agreements concluded via the shop and accepts no liability for incoming payments, chargebacks, or disputes between the client and their buyers. The contractual and fee terms of Stripe apply to the Stripe account.
Responsibility of the shop operator: The client is the sole provider of the goods sold in the shop and is responsible for their legality, for correct product information and price disclosure (including the Price Disclosure Ordinance PBV), for delivery, warranty, and any return obligations, as well as for their own contractual terms/GTC towards their buyers. Machine-generated translations of product texts are a convenience service; the client verifies their accuracy.
Order data: Order and customer data from the shop are processed on the platform on behalf of the client and are intended exclusively for the client (see Privacy Policy).
Payments from end buyers in the online shop are processed via the client's own Stripe account; the client is the sole contracting party to the end buyers. The provider makes the software available and is neither a payment service provider nor a party to the purchase agreements. Provided shipping labels (e.g. for Swiss Post) are auxiliary tools; shipping, customs, and fulfilment are the client's responsibility. If landing page and lead functions are used, incoming lead data remain with the client and are processed by the provider solely for the purpose of fulfilling the client's order.
8b. Special Provisions for the Google Profile Service
The client cooperates in the setup (providing information, photos, and access credentials, as well as completing the verification steps required by Google, such as by letter, phone call, or video). The activation, display, and placement of the profile are solely at Google's or Microsoft's discretion; Pixify is responsible for professional setup and support, not for a specific activation or visibility outcome. The service is deemed rendered upon setup and handover.
8c. AI Functions (Website Concierge & Changes by Voice Command)
Where booked or available, the provider makes AI-assisted functions available, such as a question assistant on the client's website or change requests in everyday language. Responses and text suggestions are generated by machine; a specialised third-party provider is engaged as a data processor for this purpose (details in the Privacy Policy). Machine-generated content may be inaccurate in individual cases; the client reviews results before publication and bears responsibility for approved content. The provider may impose reasonable usage limits (fair use) to protect the service.
8d. Email Mailboxes
Upon request, the provider sets up email mailboxes for the client's domain. Setup is performed manually at the hosting provider; an initial password is generated automatically. Handover takes place exclusively via the password-protected client area and is displayed there once only. Transmission by email, chat, or telephone does not take place.
Obligation to change the password. The client is obliged to change the initial password themselves immediately upon retrieval, but no later than within 14 days. Instructions for doing so are available in the client area. The provider checks automatically on a daily basis whether a change has taken place and sends reminders after 3, 7, and 14 days if a change is still pending. After the deadline has passed, responsibility for the consequences of a failure to change the password lies with the client. The provider is entitled, but not obliged, to reset the password on its own initiative thereafter; the client will be notified of this in advance.
Technical access capability. The provider manages the hosting account under which the mailboxes are operated. It can reset passwords and thereby gain technical access to a mailbox. This applies with any provider of shared hosting and cannot be excluded on technical grounds. The provider accesses mailbox contents exclusively upon the client's express instruction or on the basis of a legal obligation. For higher confidentiality requirements, the provider recommends a service where the client manages the account themselves; it will advise on request.
The client is responsible for the content, use, and legally compliant operation of their mailboxes, in particular for compliance with the regulations on unsolicited bulk advertising. Backing up messages is the client's responsibility; the provider is not obliged to archive email content.
8e. Collection of Customer Reviews
The provider makes tools available in the client area for soliciting reviews (review link, QR code, message templates, and key figures from the public Google profile). Whether, when, and whom the client asks for a review is decided by the client at their own discretion and responsibility. The client ensures in particular that requests are sent only to persons who must reasonably expect them, and that the provisions on unfair competition (Art. 3 UWG) are complied with; obtaining, purchasing, or generating fake reviews is prohibited. The number, content, display, and existence of reviews are solely at Google's discretion; the provider does not guarantee any review outcome.
8f. Advertising Management (Meta)
With advertising management, the provider sets up advertising campaigns on Facebook and Instagram (Meta) in the customer's ad account, monitors them and adjusts them (test ads, pause, shift budgets within the agreed framework); it reports monthly. The ad account, the ads and the advertising budget belong to the customer. The customer pays the advertising money directly to Meta with their own payment method; the provider only invoices the monthly management fee, which is debited in advance via the customer's existing payment method. The customer grants the provider partner access to the ad account and is co-responsible for the content of the advertised offers, the image and text rights that they provide, and compliance with Meta's advertising policies. A certain level of success (reach, clicks, inquiries, sales) is not guaranteed; reviews, rejections and blocks by Meta are beyond the provider's control. Advertising management can be terminated monthly at the end of the paid month (in the customer area); the customer then pauses or ends ongoing ads themselves in their ad account or has the provider pause them before the end.
9. Availability & Support
Pixify operates the website with the diligence of a responsible provider, but cannot guarantee uninterrupted availability (e.g. maintenance, disruptions at infrastructure partners). Support is provided by e-mail at info@pixify.ch during normal business hours.
10. Liability
Pixify is liable without limitation for intent and gross negligence. Otherwise, liability – to the extent permitted by law – is excluded; in particular for slight negligence, indirect damages, loss of profit and data loss, as well as for services provided by third-party providers (domain registry, hosting infrastructure, payment service providers). Any potential liability is limited in amount to the fee paid by the customer in the current contract year.
11. Data Protection
The processing of personal data is governed by the privacy policy of Pixify.
12. Final Provisions
Pixify may adapt these terms and conditions with effect on the next renewal and informs the Customer in advance in writing. Should individual provisions be invalid, the contract remains valid in all other respects. Swiss law applies. The place of jurisdiction is – insofar as permissible – the registered office of the provider as entered in the Commercial Register; for customers who act as consumers, the mandatory places of jurisdiction under the Swiss Code of Civil Procedure (in particular Art. 32 CCP) remain reserved.
